Sexual Harassment Lawsuit Against Ernest Nimako: Vehicle in Dispute Remains in Court Custody

Adablah claimed that Nimako had harassed her sexually during her service and had taken back a Honda Civic, worth GH¢120,000, which he had bought for her but registered in his name, contrary to their agreement.

Court’s Decision and Vehicle Custody:

In response to an application filed by Nimako, the High Court ordered the Registrar of the Court to take custody of the disputed vehicle. Justice Olivia Obeng Owusu presided over the case and ruled that the car should be surrendered to the court’s registry for preservation. Nimako was also instructed to submit all documents pertaining to the vehicle to the Registrar. Consequently, Adablah, who arrived at the court driving the car, will have to hand it over to the court as per the order.

Restrictions on Media and Social Platforms:

To ensure a fair trial, the court ordered both parties to refrain from making any commentaries or sharing videos, pictures, or materials related to the case on social media and traditional media platforms. The aim is to prevent any potential prejudice to the case until a final verdict is reached. This ruling came after lawyers representing Nimako requested the court to restrain Adablah from involving him in continuous publications on TikTok, Instagram, and other social media platforms.

The Bank’s Request and Preliminary Application:

First Atlantic Bank, following the lawsuit filed by Adablah, submitted an application requesting its name to be withdrawn from the case. The bank argued that specific paragraphs in the writ, accusing it of negligence in handling sexual harassment complaints, lacked a reasonable cause of action. The court will address this preliminary application before proceeding with the main case involving the allegations of sexual harassment.
